Frequently Asked Questions about PPL membership

We have compiled a list of the most frequently asked questions to explain this area of the law, who is eligible for PPL membership and how you can start earning royalties with us. Can I join PPL?

This section will help you if you are unsure whether you are eligible to join PPL as a member:

Why should I join PPL?
- Becoming a member of PPL means you can start to collect the money you are owed for your recorded music – and joining us is free. Apart from administration costs, our members receive 100% of the money we collect for them.
  
  If you've performed on recorded music that has been broadcast or played in public, you could be entitled to royalties. Find out if you qualify as a performer.
  
  If you control the rights for when recorded music is broadcast and played in public, PPL could be making money for you. Find out if you qualify as a rights holder.

Who can join PPL as a member?
- Anyone who owns (or is the exclusive licensee) the rights for when recorded music is broadcast or played in public in the UK can join PPL as a recording rights holder member.
  
  Anyone who has performed on recorded music can join PPL as a performer member.

What type of performer contributions are eligible for PPL royalties?
- Not all performer contributions will be eligible for royalties. Generally all audible contributions (such as guitar or vocals) will be eligible roles. In addition, certain inaudible contributions (such as a conductor) will also be eligible.
  
  When making a performer claim against PPL repertoire, performers are requested to select a role code to identify their contribution (e.g. role code "BVC" for backing vocals). Role codes are split into a number of types, not all of which are eligible for payment. Non-payable roles include certain studio activities, which add no audible contribution to the final sound recording.

Do studio producers qualify for PPL royalties?
- Although a studio producer's contribution to recorded music track is typically inaudible, studio producers may be eligible to receive royalties from PPL for their inaudible contribution. This will only be the case where a studio producer conducts or provides a similar musical direction to another performer's live performance as it is being recorded. Alterations made to a recording after the recording has been made, such as edits or remixes, will not satisfy this test (but if the new versions involve new audible performances then these may be eligible for royalties). A studio producer who qualifies in this way is always added to the performer line-up of a recording as a non-featured performer.

What is a 'qualifying performance'?
- PPL's payments to performers are based on legal rules that set out the circumstances in which a performer's contribution will be considered a "qualifying performance". In summary, a performance can qualify in one of two ways:
  
  • Based on the country of performance (ie, where the performer gave the performance);
  
  • Based on country of residence/citizenship of the performer at the time they gave the performance.
  
  In each case, the test is whether the relevant country of performance, or country of residence/citizenship, is classed as a "qualifying" country under UK law. The list of qualifying countries is updated from time to time. It covers all EU member states, plus many other countries, each of which the UK considers offers sufficient protection of performers' rights.

Becoming a member

Find out how to join PPL and what type of membership suits you:

How do I become a PPL member?
- The myPPL service allows you to register with PPL online for both types of memberships. It is free to register and we aim to approve applications within four weeks.
  
  To complete an online registration form, simply go to the login page, select the 'Not a PPL Member?' option and follow the instructions.
  
  If you are under the age of 18 you will need a guardian to co-sign the form and provide proof of ID.
I'm both a performer and a rights holder for recorded music – how should I register?
- If you are a performer who also owns the rights to the recordings that you perform on, you should join PPL with separate performer and recording rights holder accounts.
  
  If you already have one of these accounts with PPL and have set up your myPPL access, you can begin the other registration by clicking on 'My registrations' on the myPPL home page and then 'Add another registration'. You can then select the type of account you wish to set up and begin completing the forms.

I'm a performer's manager/representative. What should I do?
- If you already represent a PPL performer and have access to a myPPL online account, please click on the 'My registrations' link on the myPPL home page and then select the option to register a new performer. You can begin the registration on behalf of the performer - please ask them to sign the contracts in order to return the application to PPL for processing.
  
  If you do not already represent a PPL performer, or do not have access to the myPPL service, please contact Member Services on 0207 534 1234 so we can set this access up and advise you on what to do next.
What rights in my recordings are granted to PPL when I join as a member?
- Joining PPL as a performer does not involve transferring any rights. PPL simply collects and distributes royalties due to you as a performer from the owner of the rights in the recorded music track.
  
  Joining PPL as a rights holder member involves transferring the right to play in public or broadcast your recorded music to PPL. All other rights in your recorded music remain with you.
  
  If you additionally choose to appoint PPL to manage your new media rights or programme distribution rights, then you retain these rights but appoint PPL as your non-exclusive agent to enter into licences on your behalf.
  
  If you choose to appoint PPL to collect royalties internationally, either as a performer or as a rights holder member, then you are appointing PPL as your exclusive agent to do so in the countries specified.
What terms and conditions apply to PPL membership and appointments?
- The main appointment for PPL rights holder members covers when recorded music is played in public (ie, 'public performance') and broadcast. PPL also offers a number of additional optional appointments over other rights. PPL's terms have a modular structure. One part (called the General Terms) applies to all appointments. Each appointment then has its own separate part of the terms. When you join PPL online you can select which appointments to make and will then receive a set of terms applying to your membership made up of the relevant parts of the terms.   Where rights holders appoint PPL to manage rights in their music videos this is done through our sister company VPL. VPL operates a core appointment and one optional appointment covering new media rights.
  
  In addition to the membership terms, the relationship between PPL or VPL and rights holder members is also governed by the PPL or VPL company articles of association.
  
  You can join online as a PPL performer member. There are no detailed terms and conditions applying to basic membership. If you make use of PPL's international collections service then the international collections mandate will apply. Read the terms for all international collections mandates entered into after 11 January 2012. For any queries relating to international performer mandates entered into before 11 January 2012 please contact Member Services team on 020 7534 1234.
What should I do once I've joined?
- Recording rights holder members (once registration has been approved) can begin to register repertoire and products through their myPPL online account. Members can begin to earn royalties on repertoire once complete and accurate data about a recording has been entered into PPL's database. Recordings must be registered by 31 March each year in order to be eligible for inclusion in PPL's main UK payment made later that year.
  
  Performer members (once registration has been approved) can begin to make claims through their myPPL online account. To ensure that you are listed as a performer on the tracks that you've performed on, you can use our claims system. How do I make a claim?
  
  You can search for your tracks on the PPL Repertoire Database, which contains all the recordings registered with PPL. Once you have checked the details of the recording and confirmed that you are not listed as a performer, you can claim for your performance to be added to the recording data. You may need to provide evidence in some circumstances.

How can I end my membership?
- If you wish to stop being a member of PPL you can do so by writing to PPL, giving six months notice to terminate. Upon termination, all rights granted to PPL shall be re-assigned to you.
  
  You can also terminate each optional mandate individually by giving six months notice, except for international mandates which can be terminated only on 31 March in any calendar year by giving at least three months notice.
  
  You will be entitled to receive PPL royalties as normal up to the date of termination.
I'm already registered with PRS for Music – should I join PPL as well?
- PPL collects and distributes money for the use of recorded music on behalf of record companies and performers. PRS for Music (formerly the Performing Right Society (PRS) and the Mechanical Copyright Protection Society (MCPS)) collects and distributes money for the use of music and lyrics on behalf of songwriters, composers and publishers.
  
  Even if you are registered with PRS for Music as a songwriter or composer, you may also wish to register with PPL to make sure that you receive any income you are due as a performer or recording rights holder as well.
Are there any other organisations I should register with?
- PRS for Music is a UK music licensing company that collects and distributes royalties on behalf of song writers, publishers and composers. If you fit into one of these categories, you may wish to contact them for more information.

How to manage your myPPL account

This section will help you to access myPPL and use your online account effectively:

How do I get an online myPPL account and what can it be used for?
- Existing PPL members can contact Member Services to obtain access to myPPL. If you are not a member then you must register - please see the other FAQs for more details.
  
  A myPPL account is a secure online service. You can use this online facility to register with PPL as a recording rights holder or a performer, or to request ISRC details.
  
  Once you are an approved PPL member you can use your myPPL account to view payment statements, register repertoire and products, make claims, access and manage account information (such as updating contact and bank details) and search the PPL Repertoire Database.
  
  You can also contact Member Services through your myPPL account by raising a query.

How do I login to myPPL? What if I've forgotten my details or only have details for the previous version of myPPL?
- To login to myPPL enter your email address and password on the right-hand side of the screen.
  
  If you have forgotten your password, you can use the 'Reset Password' link on the lower right-hand side of the screen.
  
  If you used the old version of myPPL and have not yet registered for the updated version, please contact Members Services on 0207 534 1234 and we will assist you.

How can I update my bank/contact details?
- You can now update your bank details through your secure myPPL account. Once you have logged in, please click on 'Update my account details' on the myPPL home page. Select your account name and 'Edit' to input your new details. Once saved, your details will be updated on the account immediately.
  
  Please note, an address must be listed or PPL is not able to make payment to you due to UK tax restrictions.

I'm aware that a PPL performer has died and I am their beneficiary or the executor of their will. What should I do?
- A performer's right to receive royalties (or 'equitable remuneration') is transmissible upon death. PPL will require certain documentation in order to process the transfer of this right to a beneficiary. Please contact PPL's Member Services team on 020 7534 1234 or via email at performer@ppluk.com.
I'm aware that a record company has gone into liquidation or administration, or that an individual (or sole-trader) who is a recording rights holder has been declared bankrupt. What should I do?
- Please contact PPL's Member Services team on 0207 534 1234 or email us at recordcompany@ppluk.com with these details. Certain insolvency events may cause a PPL membership to terminate and PPL will need to liaise directly with the so-called 'office holder' (e.g. an administrator or liquidator) to seek further information. PPL will usually place the relevant member's account on hold while further information is sought.
As a performer, how do I let PPL know I performed on a recording I'm not linked to?
- To ensure that you are listed as a performer on all the recordings that you've performed on, you should use our online claims system.
  
  You can search for your recordings on the PPL Repertoire Database, which contains all the recordings registered with PPL. Once you have checked the details of the recording and confirmed that you are not listed as a performer, you can claim for your performance to be added to the performer line-up. You may need to provide evidence in some circumstances.
  
  You will be sent an email for each claim that you need to supply evidence for and to notify you once your evidence has been accepted. Please note that once evidence is supplied it can take a few months for your claim to be processed by our Member Services department.

When should I submit a performer claim?
- You can make a performer claim via your myPPL account once your registration is approved. Your claim may be accepted automatically or you may be required to provide supporting evidence.
  
  If your claim has been accepted, you should receive your share of any PPL royalties generated from the recordings in the next adjustment payment. See the payment timetable.

What is my performer category and role code?
- Contribution categories help PPL calculate the share of the money that individual performers should receive when recorded music is used. There are three contribution categories for performers:
  
  1. Contracted featured performer - a performer who is bound by an exclusive agreement with the relevant record company to perform on the recorded music and who is credited as the lead artist or conductor on that recording. This does not include agreements to do session work or producer/remixer agreements
  
  2. Other featured performer - a performer who contributes an audible contribution to recorded music and is:
  (a) a lead vocalist not exclusively contracted to the commissioning record company;
  (b) a performer not exclusively contracted to the commissioning record company but whose personal or professional name appears with or is linked to the name of the 'contracted featured performer' on the track; or
  (c) a performer who is entitled under the terms of a contract with the 'contracted featured performer' to receive royalties from sales of the recording.
  
  3. Non-featured performer - a performer who is not a 'contracted featured performer' or an 'other featured performer', for example, session musicians and backing singers.
  
  The role code represents the nature of the contribution a performer has made on a recording.

Managing your repertoire

Find out how to use the PPL Repertoire Database and start earning PPL royalties:

How do I add new recordings into the PPL Repertoire Database?
- Only recording rights holder members may register new recordings into the database; performers can only claim on existing recordings. If you are a performer and your recording has not yet been entered into the PPL Repertoire Database, please inform the record company so that you can claim if necessary.
  
  Once you are an approved PPL member you can use your online myPPL account to register new repertoire and products or update existing repertoire. Download the quick guide or read the full detailed guide on how to enter recordings or products into the PPL Repertoire Database.
  
  Register a new recording by logging into your myPPL account and clicking 'Repertoire Registrations'. Select the option to 'Register Recording' and fill in the required fields of recording details, contributions, repertoire ownership, rights holders and publishers. You can set up defaults for recording or product details and performer line-ups to quicken the process
  
  If you wish to register a new product (for example, an album of recorded music), you must first add each individual recording as above and then click on 'Register Product'. Complete the required information and add the track listings.
  
  It is the responsibility of the recording rights holder to submit a full performer line-up with each new recording.
How can I update an existing recording in the PPL Repertoire Database?
- If you would like to update a recording that you had previously submitted into the PPL Repertoire Database (to add some additional information or remove/replace data now known to be incorrect), login to your online myPPL account. Click on the 'Repertoire' tab and search for the recording you wish to update.
  
  Select the recording you require and click on 'Edit Repertoire'. Make all the corrections you require and 'Save'. Once you are satisfied, 'Send' the data to PPL.
  
  If you are a performer member and wish to add yourself to an existing recording listed within the PPL Repertoire Database, you must make a claim.
What do I need to do for repertoire to be accepted and start earning royalties?
- To make sure a new recording will be accepted into the PPL Repertoire Database, please ensure that it complies with PPL's Data Policy and that the following data have been correctly entered:
  
  • ISRC
  • Title of the recording
  • Band/artist name
  • Content type
  • Country of recording
  • Country of commissioning
  • Date
  • Repertoire owner
  
  Recording rights holder members must ensure they have entered their name, ownership type, the date they acquired the rights and their rights percentage (if applicable). Rights holder must also supply a full contributor line-up for the recording.
  
  PPL will proactively contact members if any data is missing or found to be invalid. If recordings are not fully completed or have incorrect information then they are deemed to be 'invalid recordings' any PPL royalties earned will be held until the outstanding information is submitted. Recordings must be registered by 31 March each year in order to be eligible for inclusion in PPL's main UK distribution made later that year.
How can I see a list of all the repertoire that I'm linked to or have registered with PPL?
- You can search the PPL Repertoire Database via your online myPPL account. If you are a performer, select 'My Repertoire' in your search criteria to view the repertoire you are linked to. If you are a recording rights holder, please select 'My Registrations' to see all of the repertoire you have registered or 'My Repertoire' to see all the repertoire you are linked to.
How do I get an International Standard Recording Code (ISRC)? And what are they for?
- The International Standard Recording Code (ISRC) system is the international system for the identification of recorded music and music videos. Each ISRC is a unique identifier that can be permanently encoded into a recording or music video. Encoded ISRCs automatically identify recordings for PPL payments.
  
  PPL is the appointed sole agency for ISRCs in the UK. You should request an ISRC 'stem' (or first registrant code) when you become a PPL recording rights holder member. This stem is three letters allocated in sequence from PPL's database that are specific to each recording rights holder member.
  
  Once you have registered as a PPL recording rights holder member, you can request an ISRC by raising a query through your myPPL account. If you are not a member and require an ISRC only, please register online and select the 'ISRC only' option.
I have recently acquired a catalogue. How can I transfer the rights in the underlying repertoire to my account?
- You will need to supply PPL with certain information and documentation before PPL is able to effect the transfer of repertoire. PPL will need information on the context of the transfer of rights, including confirmation of the relevant repertoire, the relevant date of the transfer and the scope of the rights that have been acquired. PPL may also require documentary evidence of the acquisition. Please contact PPL's Member Services team on 0207 534 1234 or email us at recordcompany@ppluk.com and we can assist you.
What should I do if my recording has been sampled?
- Once use of a sample is established, all performers on the sampled recording (irrespective of which part of the sampled recording has been used) are added to the performer line-up on the new recorded music track as non-featured performers. In certain circumstances, featured performers on the sampled recording may be added as other featured performers. Only those performers who qualified for payment on the sampled recording will qualify for payment for the use of the sampled recording on the new sound recording.
What is the PPL Data Policy?
- The PPL Data Policy defines of all the information required for a recording to qualify to earn revenue from PPL.

Repertoire disagreements

What happens if another PPL member claims to control the rights in recordings which I think I hold the rights?
- When PPL receive a claim from another member on repertoire that already has a recording rights owner, the recording will enter PPL's informal dispute resolution process. Each claiming member will be requested to confirm their claim and supply evidence of their claim. PPL will set deadlines for the submission of evidence, after which it will make a decision based on the information provided.
What happens if I disagree with the outcome of PPL's informal dispute resolution process?
- Where members wish to appeal a decision resulting from PPL's informal process, PPL recommends that the parties submit the matter to adjudication and, if necessary, arbitration. These are more formal dispute resolution procedures that PPL has introduced to offer its members flexible, cost effective, confidential and expeditious processes.

How do PPL distribute the royalties?

This section will explain how the PPL royalties are distributed between members:

Where do the royalties come from?
- PPL collects money from those that play recorded music (broadcasters, businesses, venues and other licensees) and distributes the revenue to PPL recording rights holder and performer members based on which recordings have been used. See what happens to PPL's licence fees.
How is the money distributed between performers and rights holders in the UK?
- Where the money relates to the licensing of recorded music being played in public or broadcast (subject to the allocation of costs), one half of the money is allocated to the relevant recording rights holder member and the other half is allocated to the performers who qualify to receive royalties on the recorded music track. Before a performer's share is distributed, PPL checks that the performer qualifies to receive 'equitable remuneration' in respect of that recorded music track.
  
  If there is more than one performer listed on a recording, the performer royalties are distributed between them either in accordance with a performer share agreement or PPL's Performer Allocation Policy.
  
  Where the money relates to the licensing of an activity where performers do not have a right to receive royalties (such as the copying of the track) all the money is allocated to the relevant recording rights holder. Find out more about how PPL distribute the royalties.

What's a performer share agreement?
- As an alternative to PPL's standard Performer Allocation Policy, performers can specify to PPL how the performer royalties should be distributed among the contributors linked to a recording.
  
  Performer share agreements can cover either the share of the royalties that the featured performers receive or the entire allocation across all listed performers for that recording. Performer share agreements must contain the signature of all affected performers (so either all featured performers or all performers for that recording must sign) together with the written agreement of the recording rights holder.
  
  A performer share agreement cannot affect payments retrospectively where it would result in a loss of revenue to any performer's previous PPL payments for that recording, or make a non-qualifying performer qualifying for PPL's purposes.

Understanding your payments

Find out when you should get paid and what your statement means:

When will I get paid?
- PPL makes an annual distribution to its members for UK revenue, scheduled for June each year. Royalties generated internationally and through certain additional licensing activities is paid separately throughout the year. See the payment dates.
  
  Valid repertoire must be registered with PPL by 31 March 2012 to be included in the main annual UK distribution for 2011.
Why haven't I been paid?
- If you are a registered PPL member and have been expecting a payment that has not arrived, there could be several reasons why:
  
  • Incorrect bank/address details
  PPL cannot make any payments if bank details are incorrect or if there is not a correct address listed in a member's myPPL online account. The money will be held until the details are corrected.
  
  • Account has a negative balance
  Your account may have a negative balance for several reasons. Find out more about negative balances. Future royalties will be used to make up the deficit.
  
  • Earned less than the minimum payment
  PPL will only pay if the account has earned £5.00 or more for UK payments and £50 for international payments.
  
  • The recording is invalid
  PPL will not pay out to recording rights holders for recordings that are incorrect or incomplete in the PPL Repertoire Database. It is the responsibility of the recording rights holder to ensure the data is correct. Performer payments are not affected by a recording being classed as invalid.
  
  • Your performance is not linked to a recording
  A performer member must be listed on a recording in the PPL Repertoire Database as a contributor before being paid for that recording. How do I make a claim?
  
  • Your recording has not been played in public or broadcast
  If a member believes that their repertoire has been played in public or broadcast but they have not subsequently been paid, they may raise a query with PPL. Members must raise a query within six months of the distribution and within three months of an adjustment, and may submit multiple queries at the same time. If PPL accepts queries outside these timescales, then PPL will charge a fee of £50 that is refundable if the member earns it back through the investigation.
  
  If you wish to submit a query, complete the Music Usage Investigation Request form and email it to either performer@ppluk.com or recordcompany@ppluk.com.
Why can't I access my old statements (pre-July 2011)?
- PPL has recently launched a new and improved payment system. Statements for any payments made before July 2011 were only available through the previous version of myPPL, which is now closed.
  
  Statements from July 2011 and onwards are now available in your new myPPL online account. Members are able to view their statements by logging into myPPL and selecting 'My Statements'.

How can I earn more from PPL?
- Once you have registered as a PPL member, there are numerous ways to make sure you are earning the most you can from your recordings or performances. Find out more.
Can I check how much money I'm earning on a particular track?
- If you are registered with PPL as a performer or recording rights holder member you can access your statements via your online myPPL account. Once logged in, click on 'My Statements' to find a file (CSV file) which contains a breakdown of your earnings by recording for the UK.
Are there any recording breakdowns for international payments?
- PPL does not often receive this detailed level of information from music licensing companies in other countries and so cannot include the payment breakdown on your statement. We are working on introducing this information into the statements where it is available, but for now if you require a track breakdown for international payments please contact us on 020 7534 1234. Please note that this information is not available for some countries.
Does PPL make retrospective payments?
- PPL makes adjustments to distributions for a period of up to six years, in line with the statutory limitation period. PPL no longer holds any revenue for distribution periods prior to 2004.
  
  The distribution periods for 2004-05 are expected to be closed in 2013.
What is an adjustment?
- An adjustment is when PPL recalculates the royalties allocated to recordings based on new or updated information, such as recordings being made valid or additional performers being included on a recording's performer line-up. In an adjustment PPL does not pay out any new revenue; royalties that have been previously paid out are simply re-allocated to reflect the new information that PPL has.
  
  The adjustment process can result in either a positive or negative balance of royalties to performers and/or recording rights holders. Read more about negative balances.
  
  If you receive a payment in the adjustment you can access a statement in your myPPL account. (Please note that if your account has a negative balance then you will not receive a statement.) The payment amount shown in the CSV file may differ slightly to the amount displayed on the corresponding statement because track allocations under a penny are not shown on your CSV file. This discrepancy is intentional and won't change the amount you are paid.

What does my statement mean?
- PPL produces a statement for each member payment. Members can access their statements by logging into the myPPL online account and selecting 'My Statements'. See an example statement here.

Why is my statement showing a negative balance?
- Your account may have a negative balance for several reasons. As a performer member, another performer might have made a successful claim on a recording you are currently linked to; you might have been listed incorrectly on a recording and been removed; or there might have been a change in your contribution category or listed country of residence.
  
  As a recording rights holder member, your recordings may have been transferred to another member; if performers have been added to your track; or you were paid an advance by PPL that your distribution did not match.

My statement refers to the 'BGM Tribunal Refund' – what is this?
- This refers to PPL's background music tariff refund. Following a decision by the Copyright Tribunal in October 2009, PPL had to reduce its licence fees for playing background music in pubs, restaurants, hotels, shops, factories and offices. These revised licence fees were backdated to January 2006 and PPL consequently offered refunds to its affected licensees. The Copyright Tribunal decision means that each PPL member who received revenue for background music in 2006-09 was effectively overpaid. PPL is therefore recouping these overpayments by making deductions to its main distributions, with the final deduction scheduled for PPL's June 2012 distribution. The BGM deduction from your account has been calculated based on track earnings on the three background music tariffs across 2006-2009. PPL has considered the process carefully and engaged Deloitte to ensure that the deductions have been made fairly.
  
  In April 2010 PPL's Finance Committee and Board agreed to spread the refund deductions over three years between 2010 and 2012 to smooth the effect on PPL's members. This has/will be done as follows:
  
  • The distribution of 2009 revenue in June 2010 was reduced at the top level by those refunds relating to 2009. As a result the deduction was not distinctly shown on a member's statement, as they just received lower Public Performance earnings.
  
  • The first half of the remaining 'historic' deduction relating to 2006-2008 revenue was deducted from members accounts as part of the main UK distribution in June 2011. Negative allocations were made against each member relative to track earnings on the three tariffs across these years. As this is a historic adjustment it will be clearly shown as a negative amount on their statements.
  
  • The second half of the remaining 'historic' deduction relating to 2006-2008 revenue will be deducted from members accounts as part of the main UK distribution in June 2012. As this is a historic adjustment it will be clearly shown as a negative amount on their statements.
Why have I been deducted Withholding Tax?
- There are two types of Withholding Tax that may be deducted from your PPL payments. 'Withholding Tax on Interest' can be deducted on any interest payments you receive, while 'Withholding Tax on Royalty' can be deducted on UK source income paid to certain members whose usual place of address is outside of the UK.
